Immigration border controls by COVID will continue following a ruling by the US Supreme Court

 



WASHINGTON/CIUDAD JUAREZ, Mexico, Dec 19 (Reuters) - The United States Supreme Court said on Monday that COVID-era border rules that have stopped hundreds of thousands of migrants from claiming asylum in the United States should be maintained for the time being, agreeing with Republicans who filed a legal challenge.


Title 42 limits were enacted in March 2020, at the start of the COVID-19 epidemic, by Republican former President Donald Trump, and allowed border agents the option to quickly deport migrants to Mexico without giving them the opportunity to request asylum in the United States.

Before assuming office in 2021, Democratic U.S. President Joe Biden campaigned on repealing Trump's harsh immigration policies, but he maintained Title 42 in place for more than a year. The Centers for Disease Control and Prevention (CDC) said earlier this year that Title 42 was no longer necessary for public health reasons, and the Biden administration has stated that it wants it to be repealed but would follow any court findings.

In response to a complaint initially launched by asylum-seeking migrants represented by the American Civil Liberties Union, a federal court determined last month that Title 42 was unconstitutional. The judge ordered that the limitations be relaxed on Wednesday, December 21.

However, a coalition of 19 states with Republican attorneys general tried to reverse that ruling by participating in the case, and their motion was heard by the conservative-leaning Supreme Court on Monday.



Hours later, in a short ruling, Chief Justice John Roberts issued a stay that will keep Title 42 in effect until further notice from the court. The court has given the parties in the legal dispute until Tuesday at 5 p.m. ET (2200 GMT) to react.
